CUBIC | END USER LICENSE AGREEMENT

Effective Date: January 26, 2024

1. License Grant
This Agreement, between the end user ("You") and CUBIC Co., Ltd. ("Licensor"), grants a non-transferable, non-exclusive license to use the CUBIC Package Design Platform ("Licensed Application") on devices owned or controlled by You in accordance with these terms.

2. Data Usage and Privacy
In compliance with our Privacy Policy, located at Thai Pet Industrial Company Limited's Privacy Policy, this Agreement outlines our practices regarding data collection, usage, and protection. Your continued use of the Licensed Application signifies your consent to these practices.

3. Termination
This License is effective until terminated by either party. Your rights under this License will cease automatically without notice if You fail to comply with any of its terms.

4. Use of External Services
The Licensed Application may provide access to third-party services and content. The Licensor disclaims any responsibility for such services and advises that their use is subject to associated third-party terms.

5. Warranty Disclaimer
The Licensed Application is provided "as is," without warranty of any kind. The Licensor expressly disclaims all warranties, either express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose.

6. Liability Limitation
The Licensor shall not be liable for any incidental, special, indirect, or consequential damages, including damages for lost profits, arising out of or related to the use of the Licensed Application.

7. Legal Compliance
You warrant that your use of the Licensed Application complies with all applicable laws and regulations, including export control laws.

9. Compliance with Third-Party Terms
Your use of the Licensed Application must adhere to any applicable third-party terms of agreement.

10. Third-Party Beneficiaries
Apple Inc. and its subsidiaries are acknowledged as third-party beneficiaries of this Agreement, with the right to enforce its terms.

This EULA is subject to future modifications. Continued usage of the Licensed Application constitutes acceptance of these modifications.
